FIRPTA refund warning highlighting the financial consequences of missed IRS refund deadlines for foreign property sellers.
FIRPTA withholding can involve tens of thousands of dollars. Protect your refund rights before it's too late.

Two recent cases. Substantial withholding. Years of inattention. Money that may never be recovered.

Within just a few months, FIRPTA Refunds, LLC encountered two foreign sellers who had lost the opportunity to recover substantial FIRPTA withholding.

Combined, the amounts exceeded $100,000.

Both situations raise an uncomfortable question:

How do you allow tens of thousands of dollars withheld from your real estate sale proceeds to go unresolved for years?

Especially when the relatively modest cost of timely professional assistance could have helped protect those funds.

Seven Years Later—An IRS Letter Offers False Hope

In one recent inquiry, a foreign seller sought help recovering approximately $40,000 withheld from a U.S. property sale more than seven years earlier.

An IRS letter requesting identity verification had raised hopes that the refund might still be available.

But an IRS letter is not a promise of payment.

When we requested the relevant tax return and proof of filing, the individual could produce only an incomplete, unsigned return from an earlier year and the original closing statement.

There was no evidence establishing that a timely refund claim had been filed.

The withholding was documented. The right to recover it was not.

Despite offering to pay several hundred dollars for our assistance, the individual could not provide a reasonable basis for pursuing recovery.

We declined the engagement.

When Professional Assistance Becomes a Waste of Money

There's a significant difference between a difficult FIRPTA refund case and one where statutory limitations have eliminated the right to recover the funds.

Under IRC §6511, refund claims are subject to strict filing deadlines and separate limitations on the amounts recoverable.

Once those rights have expired, attempting to claw back the money without legitimate legal or factual grounds can simply compound the loss.

A responsible professional should know when to pursue a case—and when to tell a prospective client that spending more money is unlikely to help.

It's Your Money. Protect It.

The most troubling aspect of these cases is not simply the money lost.

It's that the relatively modest cost of professional assistance at or around closing could have helped the sellers understand their obligations, protect their refund rights, and avoid years of uncertainty.

Hiring a professional does not eliminate your responsibility.

Obtain your documents. Confirm your tax returns were filed. Follow up on your refund. And never assume someone else has taken care of everything.

When substantial amounts are withheld, inattention can become extraordinarily expensive.

Stay on top of your business! It's your money, your responsibility, and potentially your loss.
