Most closing professionals are familiar with one of the biggest changes affecting FIRPTA withholding.


FIRPTA EFTPS Payment Timing Requirements


Electronic remittance through the Electronic Federal Tax Payment System (EFTPS) is replacing paper check payments, while the statutory requirement to remit FIRPTA withholding within 20 days after closing remains unchanged.


The real issue, however, isn't the electronic payment mandate.


It's the hidden timing requirements that accompany it.


Unlike mailing a paper check or making a typical online credit card payment, EFTPS uses the Automated Clearing House (ACH) banking network. Payments generally must be scheduled by 8:00 p.m. Eastern Time on the business day before the requested payment date. Depending on the calendar, weekends and federal holidays can further reduce the practical time available to complete a timely payment.


First-time users face an additional challenge. EFTPS enrollment must be completed before payments can be scheduled, and the registration process itself requires advance planning.


The result is a timing trap that many buyers, settlement agents, and closing professionals don't anticipate.


Although the legal deadline remains twenty days after closing, waiting until the twentieth day to begin the payment process may already be too late.


Successful FIRPTA compliance now requires more than correctly preparing IRS Forms 8288 and 8288-A. It also requires understanding EFTPS enrollment requirements, payment scheduling rules, banking processing times, weekends, and federal holidays before the transaction reaches its filing deadline.
